Managing bad tenants is one of many challenges of a rental property. If the tenant has violated the lease agreement, you can evict them. What if they haven’t violated lease terms but are causing problems in another way? Maybe, they’re too loud, cook strong-smelling food, or are generally rude to people?
If you are in a similar situation and looking for a stress-free way out, here are a few ideas.
1. Do Not Renew Their Lease
The best way to get rid of a problematic tenant who hasn’t violated the lease terms is to wait until the agreement expires. Depending on the terms of the agreement and state laws, you will have to issue a 30- or 60-day notice that the contract will not be renewed.
Not renewing the lease is the most stress-free solution as landlords are not required to extend or renew leases. You can ask them to vacate the property at the given time without mentioning a reason. But remember to be polite and choose your words carefully to avoid discrimination suits or other legal complications.
2. Warn Them About Legal Complications
If you suspect the tenant is involved in illegal activities, remind them gently that they’re not only violating the terms of the lease agreement but also the law. You can tell them what would happen if you find evidence of illegal activities and even let them know the consequences of a full-scale investigation.
It’s best to send this warning as a letter drafted by a lawyer and send it to all your tenants to avoid legal complications.
3. Buy Them Out
If you cannot wait until the lease expires or do not want to choose the second option, consider buying them out. You may have to spend a few hundred dollars. Still, it’s cheaper than going through the eviction process, which is expensive and cumbersome. Offer them money to move out at a given time.
